Terms of Service

MODERNSPEAK is for legitimate business development outreach. You agree not to use the service to send unsolicited bulk email, impersonate others, misrepresent creators or performance data, scrape or resell our data, attempt to breach security or access other accounts, or violate any applicable law, including anti-spam laws such as CASL and CAN-SPAM.

You are responsible for keeping your login credentials secure, for all activity under your account, and for the accuracy of the information you enter. You must be at least the age of majority in your jurisdiction and authorized to represent the creators and brands you manage in the product. Notify us immediately of any unauthorized access.

Paid plans are billed in advance on a monthly or annual basis through Stripe and renew automatically until cancelled. Free trials convert to paid plans unless cancelled before the trial ends. You may cancel at any time; cancellation stops future charges and access continues to the end of the current billing period. Fees already paid are non-refundable except where required by law. We may change pricing with reasonable advance notice.

We work to keep MODERNSPEAK available and reliable, but the service is provided on an "as is" and "as available" basis without warranties of any kind. Features that depend on third parties — including AI model providers, Gmail, and payment processors — may be interrupted or changed. We may perform maintenance, modify features, or discontinue features over time.

To the maximum extent permitted by law, MODERNSPEAK is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost deals, lost revenue, or lost data. Our total aggregate liability arising out of or relating to the service is limited to the amounts you paid us in the twelve months preceding the claim. You are responsible for reviewing AI-generated content before sending it.

We own the MODERNSPEAK platform, software, branding, and all related intellectual property. You retain ownership of the content and data you submit, and you grant us a limited licence to process it in order to operate and improve user-facing features of the service. Output generated for you through the product is yours to use in your business.

You may stop using the service and cancel your subscription at any time. We may suspend or terminate your account for breach of these terms, non-payment, or unlawful or abusive use. On termination, your access ends and we may delete your data after a reasonable period.

These terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, and the courts of Alberta, Canada have exclusive jurisdiction over any dispute.
